La prospection n'est pas un art — c'est une science. Trois lois la gouvernent. Première loi : la constance. Un appel par-ci, un SMS par-là, c'est insuffisant. Vous devez toucher votre prospect en moyenne 7 fois avant qu'il ne vous rappelle. Deuxième loi : la valeur ajoutée. Chaque contact doit apporter quelque chose — une astuce, un conseil, une réduction limitée. Troisième loi : la qualification. Tous les prospects ne valent pas la peine. Vous devez apprendre à identifier rapidement ceux qui vont vous faire 80% de votre CA.
Extrait 2 — Script d'appel gagnant
« Bonjour, c'est [Prénom] de [Entreprise]. Je vous appelle parce que notre méthode de diagnostic travaux en 48h a permis à [nombre] propriétaires en Île-de-France d'éviter en moyenne 15 000 € de mauvaises surprises. Vous avez 30 secondes ? » Le secret : être direct, chiffré et bénéfice-orienté. Pas de blabla « on n'sait jamais », pas de « vous êtes occupé ». Allez droit au but.
Extrait 3 — Construire sa zone de prospection
Trop d'artisans prospectent n'importe comment. Ils tapent à la porte du voisin du voisin et espèrent. C'est un gaspillage. Vous devez définir une zone de prospection claire : carré géographique de 5-15km autour de votre base d'opérations. Puis, à l'intérieur, cartographier chaque immeuble, chaque copropriété, identifier les syndics, les gestionnaires immobiliers. C'est votre base de données locale.

Vous recevez un mandat d'une maison des années 70 qui fait peur à l'acquéreur potentiel. Au lieu de négocier à la baisse, changez la narration. « Cet immeuble a du potentiel. These GTC govern the contractual relationship between the Service Provider and any Client (professional or consumer) for all of the following services: works audits, site supervision, BTP strategic consulting, coaching, craftsman referrals, quote analysis, website creation and maintenance, professional photo and video shoots, editorial content production (including AI-generated or AI-assisted), and the sale of PDF manuals and digital guides.
Any deviation from these GTC must be the subject of a prior written agreement signed by both parties. The Client's own GTC, including its general purchasing conditions, do not apply unless expressly accepted in writing by the Service Provider.
Every bespoke service is the subject of a written quote detailing the nature of the work, the price excl. VAT, timelines, expected deliverables and, where applicable, the payment schedule. The quote is valid for 30 days from the date of issue. The order is deemed firm upon receipt of the signed quote and the agreed deposit.
For products sold directly through the online shop (PDF manuals, packs), the order is confirmed by full payment at the time of purchase. A confirmation email serves as proof of order.
Prices are quoted in euros, excluding VAT. The applicable VAT rate is that in force on the date of invoicing (standard rate 20% unless otherwise stated). The Service Provider is registered for French VAT under number FR86443240296.
In accordance with Article L.441-10 of the French Commercial Code, any late payment automatically and without prior notice entails: (i) late payment penalties at a rate of three times the applicable statutory interest rate, (ii) a fixed-sum recovery fee of €40 per invoice, (iii) immediate suspension of ongoing Services.
Stated timelines are indicative. They run from receipt of the deposit and all elements needed for execution (briefs, access, information, authorisations, visuals, etc.).
The Client undertakes to:
Any delay attributable to the Client results in an equivalent postponement of delivery timelines, and the Client may not invoke such delay to request a price reduction or termination.
Each deliverable must be validated by the Client within 7 working days of delivery. In the absence of written feedback within this period, the deliverable is deemed accepted without reservation.
Modification requests must be submitted in writing, consolidated and specific. Each Service includes by default two (2) rounds of amendments or corrections. Beyond this, any additional request will be subject to a written amendment or charged at an hourly rate (as stated in the quote).
Photo shoots are carried out with professional equipment (full-frame body, fixed and zoom professional lenses) and include full post-production (selection, RAW processing in professional software such as Adobe Lightroom, spot retouching).
The number of final photos delivered is specified in the quote (default: 30 to 80 retouched photos per half-day shoot). Photos are delivered in high-resolution JPEG format (additional web format on request). Original RAW files are not provided, except as a paid add-on.
The Client undertakes to obtain, prior to the shoot, written image rights authorisations from all identifiable individuals in the photos (employees, subcontractors, clients, third parties on site). The Service Provider provides a standard authorisation template upon request. The Service Provider cannot be held liable for any failure to obtain authorisation attributable to the Client.
The Client warrants that it holds the necessary rights to have the relevant property, premises, sites and projects photographed, and that no contractual clause prohibits this (notably with respect to project owners, landlords or architects).
The Client provides the Service Provider with any necessary personal protective equipment (PPE) not already owned (hard hat, high-vis vest, safety shoes, goggles). The Client informs the Service Provider of any site-specific safety rules. The Service Provider reserves the right to refuse or interrupt a service if safety conditions are not met, without such interruption giving rise to any refund.
If adverse weather makes an outdoor shoot impossible, or if the site is unavailable, the session will be rescheduled to an agreed date. Any cancellation by the Client within 48 hours of the session will be invoiced at 50% of the agreed amount; within 24 hours, 100%.
Unless otherwise stated in the quote, the rights granted to the Client constitute a non-exclusive licence for a period of five (5) years, for the following uses: Client's website, Client's social media, Client's marketing and commercial materials (flyers, brochures, quotes, newsletters), internal communications. Any other use (including resale, sub-licensing, use by affiliated entities not named in the quote) requires an additional paid assignment.
The Service Provider retains full copyright over the photographs. It may use the photographs (except those expressly designated as confidential) to promote its own portfolio (website, social media, client book), unless the Client submits a written objection prior to delivery.
Unless written dispensation is granted, photographs published by the Client must, where the medium allows, include the credit "© Gregory DURA — Performance BTP" or equivalent.
Some content produced by the Service Provider (texts, illustrative visuals, conceptual mock-ups, voice-overs, blog illustrations) may be generated or substantially modified using generative AI tools. In accordance with Regulation (EU) 2024/1689 on Artificial Intelligence (AI Act) and applicable transparency obligations, the Service Provider undertakes to:
AI may be used, upon request or with the Client's agreement, for: blog article writing, product descriptions, conceptual hero section illustrations, non-photographic ambient images, video voice-overs, SEO optimisation, translation. Any AI component is mentioned in the quote.
The Service Provider expressly prohibits itself from:
The Client is informed that the legal status of AI-generated works is currently uncertain under French and European law. Purely AI-generated content may not benefit from copyright protection. The Service Provider does not guarantee the absolute originality or exclusivity of AI-generated content: it is possible that similar content may be independently generated for a third party. The Client accepts this limitation and waives any action in this regard.
The Service Provider uses AI tools whose terms of use permit commercial use. It carries out reasonable checks to avoid outputs that are manifestly infringing. However, given the inherent nature of AI systems, an absolute guarantee of non-similarity with any pre-existing work cannot be provided.
Video services (testimonials, explainer videos, site films, training videos) are governed by the same principles as photography (Articles 7.1 to 7.8). The following additional terms apply:
Website creation includes: needs gathering, site map, bespoke responsive design, development, integration of Client-provided content, basic SEO configuration, go-live, and administration training (where included).
Hosting and domain name registration are either included in the maintenance subscription or taken out directly by the Client. In the latter case, the Client remains the sole owner of the domain name and is responsible for its renewal.
A separate maintenance contract, specifying backup frequency, technical updates, support level (SLA), SEO actions and content production, may be entered into. In the absence of such a contract, no maintenance obligation applies after delivery and acceptance.
Source code and design files are transferred to the Client after full payment, subject to third-party components (open-source libraries subject to their own licences, subscription plugins, third-party licensed fonts).
The purchase of a manual or digital guide grants the Client a personal, non-exclusive and non-transferable licence of use, limited to internal use (for professionals) or personal use (for private individuals). Expressly prohibited: resale, public distribution, making available on a website, sharing with third parties (outside household or employees of the purchasing entity), modification for commercial exploitation.
Any major update to a manual is sent free of charge by email to previous purchasers for a period of twelve (12) months from the date of purchase.
Each manual includes 30 minutes of post-purchase advice (video call or phone), to be used within 90 days of purchase. This support is personal and non-transferable.
A consumer Client may request a refund for a manual within fourteen (14) days of purchase, provided they submit the request by email to contact@performance-btp.fr explaining the reasons. The refund is processed within 14 days of the request.
Consulting, audit and coaching services constitute a best-efforts obligation and not an obligation to achieve a specific result. The Service Provider applies its expertise, experience and diligence to pursue the objectives set out in the quote, but does not guarantee any specific commercial or financial outcome (revenue, number of leads, productivity gains, etc.), as these depend on many external factors.
The recommendations and reports provided are decision-support tools: the final decision and its implementation remain the exclusive responsibility of the Client.
The Service Provider undertakes to treat as strictly confidential all information, documents, commercial, financial or technical data transmitted by the Client in connection with the Services, and not to disclose them to third parties without prior written authorisation, except as required by law.

Content provided by the Client (texts, logos, photos, trademarks) remains its exclusive property; the Client warrants that it holds the rights to these elements and indemnifies the Service Provider against any third-party claims.
Content created by the Service Provider (reports, manuals, photographs, videos, code, design) is protected by French copyright law. The assignment or licence of use is specified in Articles 7, 9, 10 and 11 depending on the nature of the deliverable. In the absence of specific terms, only a non-exclusive internal-use licence is granted; any external commercial exploitation is subject to an additional written agreement.
The Service Provider is bound by a best-efforts obligation. Its liability can only be engaged in cases of proven fault. Except in cases of gross negligence or fraud, the Service Provider's total cumulative liability, for all damages combined, is capped at the amount inclusive of VAT actually paid by the Client for the relevant Service over the preceding twelve (12) months.
The Service Provider cannot in any event be held liable for indirect damages (loss of revenue, loss of clientele, reputational harm, data loss, etc.).
The Client remains solely responsible for: (i) the content it provides to the Service Provider, (ii) the decisions it makes based on recommendations, (iii) the compliance of its activities with applicable regulations (planning, construction, safety, commercial law, etc.).
Neither party can be held liable for non-performance or delay in performance of its obligations due to a force majeure event within the meaning of Article 1218 of the French Civil Code (natural disaster, pandemic, war, general strike, major failure of an essential third-party supplier, etc.). Timelines are suspended for the duration of the event.
In the event of a material breach by either party, unremedied within fifteen (15) days following formal notice by registered letter or email with acknowledgement of receipt, the other party may terminate the contract by operation of law, without prejudice to any damages.
If the Client terminates without fault on the part of the Service Provider, amounts paid remain with the Service Provider in proportion to work completed, plus a 30% indemnity for the loss suffered (excluding unfair consumer terms).
In accordance with Article L.221-18 of the French Consumer Code, the consumer has fourteen (14) days to exercise their right of withdrawal, from the date of conclusion of the contract (for services) or receipt of the goods (for tangible products).
For services not covered by these exceptions, a standard withdrawal form is available on request at contact@performance-btp.fr.
These GTC are governed by French law. In the event of a dispute, the parties shall endeavour to find an amicable solution before taking any legal action.
Conformément aux articles L.611-1 et suivants du Code de la consommation, tout consommateur a le droit de recourir gratuitement à un médiateur de la consommation en vue de la résolution amiable du litige qui l'oppose au Prestataire. Le Client peut saisir la plateforme européenne de règlement en ligne des litiges : ec.europa.eu/consumers/odr.
In the absence of an amicable resolution, and subject to the mandatory jurisdictional rules applicable to consumers, any dispute relating to these GTC shall be submitted to the competent courts of Nanterre (92).
By confirming an order, signing a quote or downloading paid content, the Client acknowledges having read these GTC, understood them and accepted them without reservation.
